Federal Circuit Court Upholds ITC Ruling in Favor of Kapsch

MCLEAN, Va.–(BUSINESS WIRE)–Kapsch TrafficCom (Kapsch) is pleased to announce that the U.S. Court of
Appeals for the Federal Circuit affirmed last week the International
Trade Commission (ITC) decision that Kapsch does not violate any of
Neology, Inc.’s patent claims by importing electronic tolling products
using the ISO/IEC 18000-6C communications protocol (6C Standard) because
the subject patent claims are invalid. Several of Neology’s 6C Standard
patent claims were already invalidated by the United States Patent and
Trademark Office (USPTO) in 2015, and the ITC had rejected as invalid
several more claims in 2017.

This important Federal Circuit decision further confirms and solidifies
the right of Kapsch and other industry suppliers to operate and compete
freely in the 6C Standard tolling marketplace, and to market, sell, and
distribute 6C Standard tolling tags and readers to its customers
throughout North America. Kapsch is a firm believer in open protocols in
support of national electronic tolling interoperability. “Ensuring a
